Terms of Service

Welcome to Digital Dynasty. These Terms of Service (the “Terms”) are an agreement between you and Digital Dynasty LLC (“Digital Dynasty”, “we”, “us”) and cover your use of our website and transcription service (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

1. Who can use Digital Dynasty

You must be at least 18 years old and able to enter into a binding agreement to create an account. You’re responsible for keeping your password secure and for everything that happens under your account. Please tell us right away at robert@getdigitaldynasty.com if you think someone else has used it.

2. What the Service does

Digital Dynasty uses artificial intelligence to turn photos and scans of handwritten pages into typed text, flags words it is unsure of, and lets you review, correct and download the results, including as a Word document.

3. AI transcriptions can contain mistakes

Handwriting recognition is never perfect. Transcriptions may contain misread words, wrong names, dates or numbers, or missing text, and flagged words are a guide rather than a complete list of errors. You are responsible for reviewing transcriptions before relying on them, especially for legal, medical, financial, genealogical or historical purposes. The Service is a tool to help you read your documents; it is not professional, legal or archival advice.

4. Your content

“Your content” means the images you upload and the transcriptions, names, notes and other information you add or create in the Service. You keep all ownership of your content.

So that we can run the Service, you give us a limited, non-exclusive, worldwide, royalty-free permission to store, copy, process and display your content only as needed to provide the Service to you: for example, to send page images to the AI services that transcribe them, to show your pages back to you, and to create your downloads. We do not sell your content, publish it, or use it to train AI models. This permission ends when you delete the content or your account, except for copies kept briefly in backups as described in our Privacy Policy.

When you upload content, you confirm that:

• you own it, or you have the right to upload and transcribe it (for example, it belongs to your family and you have permission to work with it);
• uploading it doesn’t break any law or anyone else’s rights, including copyright and privacy rights; and
• you’ll take reasonable care with personal information about living people that appears in your documents.

5. Acceptable use

Please don’t use the Service to:

• upload content you don’t have the right to use, or content that is illegal, including any material that sexually exploits children;
• process stolen documents or other people’s private records without permission;
• try to get around credit limits, the free-trial limits or our bot protection, or create accounts automatically;
• interfere with, overload, probe or reverse-engineer the Service, or access it other than through our website; or
• resell the Service or use it to build a competing product.

We may remove content or suspend accounts that break these rules.

6. Plans, credits and billing

• Free pages. New accounts get a one-time allowance of free pages. You may also try a single page on our homepage without an account; that page is deleted after 24 hours unless you create an account.
• Subscriptions. Paid plans are billed monthly in advance, in US dollars, through our payment processor, Stripe. Your plan renews automatically each month until you cancel. Prices are shown on our pricing page.
• Credits. Each plan includes a monthly number of credits. A Standard page uses 1 credit and a Super page uses 2. Transcribing a page again uses credits again. Unused credits do not roll over: they reset at the start of each billing month. Credits have no cash value and can’t be transferred. If a transcription fails on our side, the credits for that page are returned.
• Promotions. Discount codes apply only as described when they’re offered (for example, to the first month of your first subscription), can’t be combined unless we say so, and may end at any time.
• Changing plans. You can switch plans at any time from your account. Price differences are prorated by Stripe.
• Cancelling. You can cancel at any time from your account page. Your plan stays active until the end of the month you’ve already paid for, and then won’t renew.
• No refunds. Payments are non-refundable, including for partial months and unused credits, except where the law requires otherwise.
• Price changes. If we change the price of your plan, we’ll tell you by email at least 30 days before the new price applies, and you can cancel before then.
• Taxes. Prices don’t include any sales or similar taxes that may apply, which you’re responsible for.

7. Our property

The Service itself (our software, design, text, logos and the name Digital Dynasty) belongs to us and is protected by law. These Terms don’t give you any rights to it beyond using the Service as described here. If you send us suggestions or feedback, we may use them without any obligation to you.

8. Ending your account

You can delete your account at any time from your account page. This cancels any subscription and permanently deletes your projects, pages and transcriptions, so please download anything you want to keep first. We may suspend or end your access if you seriously or repeatedly break these Terms, if we have to by law, or if we stop offering the Service. If we stop offering the Service for reasons other than your breach, we’ll try to give you reasonable notice so you can download your content.

9. Availability

We work hard to keep the Service running and your content safe, but we can’t promise it will always be available, uninterrupted or error-free, or that content will never be lost. Large batches can take time to finish. Please keep your original documents and your own copies of anything important.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

11. Limitation of liability

To the fullest extent the law allows, Digital Dynasty will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose or US $50. Some places don’t allow these limits, so they may not all apply to you.

12. Indemnity

You agree to defend and hold Digital Dynasty harmless from claims, losses and costs (including reasonable legal fees) that arise from content you upload or from your breach of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Utah, and you and we agree to their jurisdiction. Before filing any claim, please contact us first. Most concerns can be resolved quickly by email.

14. Changes to these Terms

We may update these Terms from time to time. If we make a significant change, we’ll let you know by email or in the Service before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.

15. Other things

These Terms and our Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. Not enforcing a part of these Terms doesn’t mean we give up the right to do so later. You can’t transfer these Terms to someone else; we may transfer them as part of a merger, acquisition or sale of our business.
